Over the
last 20 years the professionals of Kalik Lewin have defended
U.S. importers and international producers and exporters of
industrial and consumer products as diverse as metals, industrial
bearings, chemicals, apparel, foodstuffs, alcoholic beverages
and machine tools before the U.S. Department of Commerce (DOC),
International Trade Commission (ITC) and the United States Trade
Representative (USTR) in multiple investigations and administrative
proceedings under Sections 701, 731, 735, 751, 753 of the Tariff
Act of 1930 (antidumping and countervailing duty) Sections 201
and 301 of the Trade Act of 1974 (safeguards and unfair trade
practices) and Section 232 of the Trade Expansion Act of 1962
(national security) against imports of these products. The firm
offers defense capabilities as well as strategic trade planning
services to manage the risks associated with the additional
tariffs and duties imposed under U.S. antidumping and countervailing
duty law and quotas imposed under U.S. safeguards actions. In
recent years, the firm has defended global clients against antidumping
and safeguards actions in China, the Philippines, Canada and
the European Union.
International
Trade Agreements and Trade Preference Programs
Kalik Lewin
has uncommon expertise in representing the interests of companies,
governments and industry groups in the negotiation and implementation
of bilateral, regional and global multilateral international
trade agreements on issues such as tariff reduction, regulatory
compliance and harmonization and unfair trade practices. In
recent years, the firm successfully negotiated international
agreements involving wine and other alcoholic beverages, international
intellectual property issues and the management of steel trade.
The firm regularly advises clients on developments in global
and regional negotiations involving NAFTA, FTAA and the WTO.
The firm offers additional expertise in the implementation of
U.S. trade preference programs such as the Generalized System
of Preferences (GSP), the Caribbean Basin Initiative (CBI),
the Andean Trade Preferences Act (ATPA) and the African Growth
and Opportunity Act (AGOA).
Legislation
The career
experience of the principals in the firm as former Congressional
staffers gives Kalik Lewin unique perspective on the process
of developing, drafting and lobbying on trade and related legislation
in the U.S. Congress. The firm addresses legislative issues
through a multi-disciplinary approach leveraging political capital,
legal expertise and strong relationships across the executive
branch and in the Senate and House of Representatives to manage
political risks and craft legislative solutions for its clients.
Customs
The firm
represents clients on all matters involving U.S. and global
customs, including classification, valuation and country-of-origin
issues. Kalik Lewin has particular expertise in strategic planning
and management of all import/export issues including informed
compliance, classification and import authorization requests,
management of drawback claims and the development of duty-free
foreign trade zones. The firm regularly represents clients before
the U.S. Customs Service on responses to requests for information,
notices of action and disputes involving classification, valuation
and drawback and has a record of success in litigation against
the Customs Service in court before the U.S. Court of International
Trade and the Court of Appeals for the Federal Circuit.
Export
Controls
Kalik Lewin
offers counseling and guidance to clients involved in the export
of high technology products and services, including encryption
software, computer hardware, biotechnology and dual-use products
such as advanced materials, machine tools and other industrial
equipment. The firm regularly advises clients on developments
in U.S. export controls regulations and policy including modifications
to country "tier" system, changes to the scope of
products subject to export controls procedures and the reporting
and documentation requirements of regulated export transactions.
Ocean
Transportation
Extensive
experience in international commercial transactions and international
trade regulation provides Kalik Lewin with expertise in the
legal aspects of ocean transportation and shipping. As counsel
to various importers, exporters, shippers' associations, and
carriers, the firm monitors legislative and regulatory developments
under the Ocean Shipping Reform Act (OSRA), regularly comments
on matters pending before the Federal Maritime Commission (FMC),
and represents clients before the Department of Transportation
on cargo preference and coastwise shipping issues.
